While bodycam footage already captured Sunny Hostin advocating for her son at the scene of his arrest, a newly obtained letter reveals she’s continuing that fight through official legal channels, this time directly appealing to the prosecutor assigned to his case.

The Incident That Started It All

Gabriel Hostin, a 24-year-old Harvard graduate, was cited for criminal trespass after officers found him within the active right-of-way of Metro-North Railroad tracks in New Rochelle on June 16. According to police, the area was clearly marked with posted no-trespassing signage, though Gabriel maintained he had entered through a gate that was standing open at the time.

A Formal Appeal for Dismissal

In a letter obtained by TMZ and addressed to Westchester Assistant District Attorney Amanda Greene, Sunny Hostin laid out a detailed defense of her son’s actions. She explained that Gabriel had been jogging when he came across what appeared to be a gravel incline suitable for hill training, and that although a gate stood at the entrance, it was open at the time he approached. She specifically noted that the only posted no-trespassing sign was affixed to one side of the gate, arguing that because the gate was open, the sign wasn’t visible to her son as he entered the property.

A Mother With Legal Standing

Hostin’s letter carries particular weight given her own background as a former federal prosecutor, a credential she referenced repeatedly both in the letter and during the original police encounter captured on bodycam. She appears to be personally representing her son as his case moves through the legal process.

The Officer’s Response at the Scene

Despite the argument outlined in the letter, officers on the scene had been clear that the location where Gabriel was standing constituted an arrestable offense under the circumstances. They ultimately opted to issue a lesser trespass violation rather than pursue harsher charges, citing his cooperative demeanor and clean background, while noting that increased camera surveillance in the area limited their discretion to overlook the incident entirely.

Where the Case Stands Now

Gabriel Hostin is due back in court in New Rochelle on July 31, where the outcome of his mother’s dismissal request is expected to become clearer. Representatives for Sunny Hostin have not provided comment on the matter.
