A Jury Now Holds Four Possible Paths Forward

The fate of Lindsay Clancy, the Massachusetts mother accused of killing her three young children, now rests in the hands of a jury weighing four dramatically different outcomes. Clancy, 36, faces charges connected to the deaths of her children, Cora, 5, Dawson, 3, and 8 month old Callan, who were strangled at the family’s Duxbury home in January 2023.

Clancy’s defense argues she should be found not guilty by reason of insanity, citing severe postpartum psychosis. Prosecutors counter that the killings were planned, pointing out that she made sure her husband was away from the home before the crimes occurred.

Scenario One: Life Without Parole

If jurors convict Clancy of first degree murder, she would face a mandatory sentence of life in prison without the possibility of parole, the most severe outcome available.

Scenario Two: A Manslaughter Conviction

Jurors could instead find her guilty of manslaughter, a lesser charge carrying up to 20 years in prison per count. Massachusetts law recognizes both voluntary manslaughter, tied to killings committed in the heat of the moment, and involuntary manslaughter, which involves an unintended death. Some legal observers, including former prosecutor Neama Rahmani, doubted a manslaughter conviction was likely, predicting instead that Clancy’s insanity defense would prevail.

Scenario Three: Committed to a Mental Institution

A third possibility is that Clancy is found not criminally responsible and committed to a psychiatric facility, potentially Bridgewater State Hospital, where her mental health would be periodically reviewed. Judge William Sullivan told jurors that commitment could last her entire life, but also noted that release remains possible if she’s eventually deemed no longer a danger.

Scenario Four: A Hung Jury

If jurors cannot reach a unanimous decision, the result could be a mistrial, sending the case back to square one. Veteran attorney Mark Bederow said he believes prosecutors may not have built a strong enough case for a life sentence, calling a hung jury or an insanity verdict a real possibility. He added that the manslaughter option gives jurors room to reach a compromise, even as he maintained that Clancy’s actions reflected clear intent.

The Case Against Her

Clancy, a former labor and delivery nurse, is accused of strangling her three children with exercise bands before attempting to take her own life by jumping from a window of her home. She claims she was experiencing a severe mental health crisis at the time and heard a man’s voice instructing her to act. Prosecutors dispute that account, with psychiatrist Dr. Gregory Saathoff testifying that Clancy appeared “methodical, quite controlled and organized” during the crimes.

Because Clancy has not disputed that the killings occurred, a standard not guilty verdict is considered highly unlikely. The jury’s decision, whichever direction it takes, will determine which of the four paths defines the rest of her life.
